Terms of Service

Please read these terms carefully before engaging Alta Property Services for any repair, restoration, or contracting work. By requesting our services, you agree to the following conditions.

Important: These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Alta Property Services LLC ("Alta," "we," "us," or "our"), located at 30 W Fay Ave, Addison, IL 60101. By contacting us, requesting a free estimate, signing a work authorization, or allowing us to perform services on your property, you confirm that you have read, understood, and agree to be bound by these Terms.

Acceptance of Terms

Access to and use of Alta Property Services' services is subject to full acceptance of these Terms. If you do not agree with any part of these Terms, you must not engage our services.

These Terms apply to all residential and commercial property services we provide, including but not limited to roofing, plumbing, electrical, siding, construction, remodeling, and emergency restoration work throughout the greater Chicagoland area — including DuPage, Cook, Will, Lake, Kane, McHenry, and Kendall Counties.

We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our services after any modification constitutes your acceptance of the revised Terms.

Scope of Services

Alta Property Services provides licensed, bonded, and insured property repair, restoration, and exterior contracting services. The specific scope of work for each project is defined in the written work authorization, proposal, or contract signed by both parties prior to commencement.

Services we provide include:

  • Roof repair, replacement, inspection, and emergency tarping
  • Plumbing services including sump pump repair, burst pipe repair, ejector pump repair, and sewer backup cleanup
  • Electrical services including panel upgrades, emergency electrical repair, and EV charger installation
  • Siding repair, replacement, and storm damage restoration
  • Interior remodeling including bathroom, kitchen, and basement finishing
  • Water and storm damage reconstruction
  • HOA and property management maintenance services
  • 24/7 emergency property services

We do not guarantee availability for all services at all times. Service availability in specific municipalities across our coverage area may vary based on scheduling and resource allocation.

Estimates & Proposals

Alta Property Services offers free estimates for most standard repair and restoration projects. An estimate represents our good-faith assessment of the anticipated cost and scope of work based on information available at the time of assessment.

Please note: All estimates are valid for 30 days from the date of issuance unless otherwise stated in writing. Estimates are not guarantees of final project cost.

Estimate Conditions

  • Estimates are based on visible and accessible conditions at the time of inspection. Concealed damage, code compliance requirements, or material price fluctuations discovered during work may result in revised pricing.
  • Estimates provided for insurance claim purposes are prepared in Xactimate format and are subject to approval by the insurer.
  • Work will not commence until a written work authorization or contract has been signed by the Client and an authorized Alta representative.
  • Emergency response services may require verbal authorization when written authorization cannot be obtained in a timely manner; written confirmation will follow within 24 hours.

Payment Terms

Payment terms are specified in your project contract or work authorization. The following general terms apply unless otherwise agreed in writing:

  • Deposit: A deposit of up to 30% of the project total may be required before work commences on projects exceeding $2,500. This covers material procurement and scheduling costs.
  • Progress Payments: For larger projects, milestone-based progress payments may be structured and outlined in the project contract.
  • Final Payment: Final payment is due upon project completion and Client walkthrough confirmation, unless otherwise stated.
  • Emergency Services: Payment for 24/7 emergency services is due in full within 14 days of service completion, unless covered by a homeowners insurance claim in active processing.
  • Insurance Claims: For insurance-covered projects, you remain ultimately responsible for any deductibles, uncovered costs, or balances not paid by your insurer. Alta bills insurers directly when authorized.

Late Payments

Accounts unpaid beyond 30 days of the invoice due date are subject to a 1.5% monthly finance charge on the outstanding balance. Alta Property Services reserves the right to suspend or withdraw from active projects where payment obligations are materially in default.

Lien Rights: In accordance with the Illinois Mechanics Lien Act (770 ILCS 60), Alta Property Services retains the right to file a mechanics lien against the property where services were rendered in the event of non-payment. Clients are advised to ensure timely payment to avoid lien proceedings.

Insurance Claims & Third-Party Billing

Alta Property Services is experienced in working directly with homeowners insurance carriers and provides Xactimate-formatted estimates to facilitate insurance claims. The following terms apply when insurance is involved:

  • You authorize Alta to communicate directly with your insurance company regarding project scope, estimates, and documentation on your behalf where a written authorization is provided.
  • Alta does not guarantee that your insurance carrier will approve or cover any specific claim or scope of work. Claim decisions rest solely with your insurer.
  • You remain responsible for your policy deductible and any portion of the project cost not covered by your insurance settlement.
  • Alta will not waive, discount, or absorb insurance deductibles, as doing so is prohibited under Illinois law.
  • Supplemental claims for scope or cost changes discovered during work will be submitted to the insurer by Alta with Client notification.

Change Orders

Any modifications to the agreed scope of work must be documented via a written change order signed by both the Client and an Alta representative prior to the additional work being performed.

  • Change orders may affect project cost, timeline, and warranty coverage.
  • Verbal change orders are not binding and will not be honored without written confirmation.
  • Work identified as necessary to meet building codes or resolve unforeseen conditions (e.g., hidden structural damage) will be communicated to the Client promptly, and a change order will be issued for approval before proceeding.
In emergency situations where Client contact cannot be immediately established and continued delay would result in further property damage or safety risk, Alta may proceed with minimum necessary protective work and document the scope for immediate Client notification.

Property Access & Client Responsibilities

By engaging Alta Property Services, you represent and warrant the following:

  • You are the property owner or are legally authorized to grant access and authorize work on the subject property.
  • You will provide safe and reasonable access to all areas of the property necessary for the performance of contracted work during agreed-upon working hours.
  • You will disclose any known hazards, defects, or conditions on the property that may affect the safety of our personnel or the quality of work performed.
  • You will ensure that pets, children, and unauthorized persons are kept clear of active work areas during the project.
  • You will obtain any required permits unless Alta has been specifically contracted to pull permits on your behalf.

Alta is not liable for delays, damage, or additional costs arising from restricted access, undisclosed property conditions, or failure to meet Client responsibilities outlined above.

Limitation of Liability

To the fullest extent permitted by applicable Illinois law, Alta Property Services' total liability to any Client for any claim arising from or related to services performed shall not exceed the total amount paid by the Client to Alta for the specific services giving rise to the claim.

  • Alta is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of income, or emotional distress.
  • Alta is not responsible for pre-existing conditions, latent defects, or damage caused by events beyond our control, including but not limited to severe weather, Acts of God, or actions of third parties.
  • Client is responsible for removing personal property, valuables, and furnishings from work areas prior to service commencement. Alta is not liable for damage to items not removed as requested.
  • Alta's liability for damage caused by our negligence is limited to the cost of repair or replacement of the directly damaged item, not to exceed the project contract value.

Warranty & Workmanship Guarantee

Alta Property Services stands behind the quality of every project we complete. Warranty terms are specific to each service type and are detailed in your project contract. General terms are as follows:

Workmanship Warranty

  • Alta provides a workmanship warranty covering defects in materials installation and craftsmanship for a period of one (1) year from the date of project completion, unless a longer period is specified in writing.
  • Warranty claims must be submitted in writing to cs@altasvcs.com or by calling (630) 461-9229.

Manufacturer Warranties

  • Materials used in your project may carry separate manufacturer warranties. Alta will pass through applicable manufacturer warranty documentation to you upon project completion.
  • Manufacturer warranties are governed by the terms set by the manufacturer and are independent of Alta's workmanship warranty.

Warranty Exclusions

  • Damage caused by subsequent weather events, improper maintenance, modifications by other contractors, or misuse
  • Normal wear and tear
  • Pre-existing conditions not addressed within the contracted scope of work
  • Work performed outside the original agreed scope at Client direction without a signed change order

Emergency Services

Alta Property Services provides 24/7 emergency response across Chicagoland for urgent property damage including roof failures, burst pipes, basement flooding, electrical hazards, and storm damage.

  • Emergency services are dispatched based on availability and geographic coverage. Response times are not guaranteed but are prioritized by severity of damage and safety risk.
  • Emergency protective measures (such as tarping, board-up, or water extraction) are performed to prevent further damage. These actions do not constitute a full repair and additional work will be scoped in a follow-up estimate.
  • Verbal authorization is accepted for emergency dispatch when written authorization cannot be obtained. Client acknowledges responsibility for charges incurred for emergency services rendered in good faith.
  • Emergency services may be subject to after-hours, weekend, or holiday surcharges as specified in the service authorization.

Cancellation & Project Termination

Client Cancellation

  • You may cancel a scheduled appointment or project without penalty with at least 48 hours' written notice prior to the scheduled start date.
  • Cancellations within 48 hours of the scheduled start may result in a cancellation fee of up to 15% of the contracted project value to cover scheduling and mobilization costs.
  • If materials have been ordered or fabricated for your project, you are responsible for the cost of those materials regardless of cancellation timing.
  • Deposits are non-refundable once materials have been ordered or work has commenced.

Alta's Right to Withdraw

Alta Property Services reserves the right to suspend or terminate a project under the following circumstances:

  • Non-payment or significant payment default
  • Unsafe working conditions that cannot be reasonably mitigated
  • Client's failure to provide required access or authorizations
  • Discovery of conditions that make completion of the contracted scope impossible, illegal, or materially unsafe

In the event Alta withdraws from a project, Client will be invoiced for all work completed and materials procured to the date of withdrawal.

Dispute Resolution

We are committed to resolving any concerns quickly and fairly. If a dispute arises in connection with any services provided by Alta Property Services, the following process applies:

  1. Direct Resolution: Contact our team first at (630) 461-9229 or cs@altasvcs.com. Most concerns can be resolved at this stage within 5 business days.
  2. Written Notice: If unresolved, submit a formal written complaint to Alta Property Services, 30 W Fay Ave, Addison, IL 60101. We will respond in writing within 10 business days.
  3. Mediation: If the dispute remains unresolved after written escalation, both parties agree to attempt resolution through a mutually agreed-upon, neutral mediator before pursuing litigation.
  4. Arbitration or Litigation: Any claims not resolved through mediation shall be subject to binding arbitration under the American Arbitration Association's Commercial Rules, or at either party's election for claims under $10,000, in DuPage County Small Claims Court.
Nothing in this section waives Alta's right to seek injunctive relief, enforce payment obligations, or file a mechanics lien where warranted under Illinois law.

Privacy & Data Collection

Alta Property Services collects personal information necessary to provide services, communicate with you, prepare estimates, and process invoices. This includes name, contact details, property address, and payment information.

  • We do not sell your personal information to third parties.
  • Information is shared with subcontractors, insurance carriers, or other parties only as necessary to perform contracted services or comply with legal obligations.
  • Project photos may be used for marketing, portfolio, or insurance documentation purposes. If you prefer your property not be featured in any marketing material, notify us in writing prior to project commencement.
  • Our website uses cookies and analytics tools to improve user experience. Use of our website constitutes acceptance of standard cookies as described in our website privacy notice.
  • You may request a copy of any personal data we hold about you, or request deletion of non-essential data, by contacting us at cs@altasvcs.com.

Governing Law & Severability

These Terms of Service are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Venue for any legal proceeding shall be in DuPage County, Illinois.

If any provision of these Terms is found to be invalid, unenforceable, or contrary to applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

These Terms, together with any signed project contract or work authorization, constitute the entire agreement between Alta Property Services and the Client with respect to the services described therein, and supersede all prior oral or written representations.
